Benjamin Overby Jr. is an associate attorney with White & Allen, P.A., serving clients from the firm’s New Bern office. His practice focuses on real estate, where he works alongside experienced White & Allen attorneys to help clients navigate their legal needs with care, clarity, and attention to their goals. He strives to communicate clearly, listen carefully, and approach every matter with honesty, diligence, and care.

Clients can expect Benjamin to work hard for them and treat their legal matter with the attention it deserves, because for Benjamin, practicing law is about more than understanding the law—it is about understanding the people and businesses behind each legal issue. He believes flexibility and clear communication are essential to serving clients from different backgrounds and with different needs.

Benjamin grew up in Burlington, North Carolina. He comes from a family of lawyers, so he was introduced to the legal profession at an early age and had the opportunity to see firsthand the important role attorneys play in the lives of their clients. He ultimately chose the profession because he enjoys learning and the intellectual challenge of solving problems.

He earned his undergraduate degree from the University of North Carolina at Chapel Hill, where he studied Exercise and Sports Science with a focus in Sport Administration and U.S. History. Benjamin graduated from the Campbell University School of Law, where he participated in the Tulane Professional Basketball Negotiation Competition and served in leadership in both the Sport and Entertainment Law Society and the Christian Legal Society.

Benjamin believes attorneys have an important role to play in strengthening the communities they serve through leadership, service, and active involvement. He values the YMCA’s commitment to healthy living and youth development and believes providing young people with opportunities to grow, stay active, and develop strong values helps build stronger communities. Throughout college and law school, Benjamin participated in volunteer and leadership activities and looks forward to continuing to serve the communities where he lives and works.

Outside the office, Benjamin enjoys running, working out, and playing sports. A lifelong UNC fan, he enjoys watching Tar Heel athletics and returning to Chapel Hill when he can. He is also working toward a personal goal of visiting every Major League Baseball stadium and has already visited 17 of the 30.

As he begins his legal career, Benjamin is focused on building his knowledge, developing strong relationships with clients and colleagues, and becoming a trusted resource for those he serves.
